Who you are agreeing with

Atlas is published by Glassrope Limited, a company registered in New Zealand. In these terms “we” and “us” mean Glassrope Limited, and “you” means the person using the app. By downloading or using Atlas you accept these terms. If you do not accept them, delete the app.

This agreement is between you and us. It is not with Apple, and Apple is not responsible for Atlas or for its contents.

Your licence

We give you a personal, non-exclusive, non-transferable licence to use Atlas on any Apple-branded device that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. You may not sell, rent, sub-licence or redistribute the app, and you may not attempt to extract its source code, except to the extent that the law says such a restriction cannot be enforced.

We keep all rights in the app itself: the software, the name, the artwork, the stamp designs and the layout of the share cards. Nothing in these terms transfers those to you.

Your photographs stay yours

Atlas claims no rights of any kind over your photographs or anything derived from them. Your library is read on your device, is never uploaded, and is never seen by us. We have no server, no account system, and no copy of anything of yours. The privacy policy sets out exactly what the app reads and what leaves the device.

Cards you export are yours to post wherever you like. Where a card shows a map, the Apple Maps credit on it has to stay, because that is a condition of using Apple’s map data.

What Atlas is, and is not

Atlas describes where your photographs were taken. It is a record for your own interest, not a document of legal or official standing. In particular:

• Place names, borders and time zones come from Apple’s map data and can be wrong, out of date, or politically contested.
• Distances are calculated between the places your photographs put you in, so they approximate how far you travelled rather than measure it.
• Country and continent counts follow the UN geoscheme. Reasonable people disagree about some of those boundaries.
• A photograph without saved coordinates cannot be placed, so a trip you took may simply not appear.

Do not rely on any figure in Atlas for a visa application, a tax residency question, or anything else where being wrong has consequences.

Acceptable use

Use Atlas lawfully, and only with photographs you are entitled to use. Do not attempt to interfere with the app, to work around the permissions iOS enforces, or to use it to infringe anyone else’s rights.

Price and availability

Atlas is free. There are no in-app purchases and no subscriptions. If that ever changes, the change will apply to new purchases only and will be described in the app’s release notes and here.

We may update, change or withdraw the app at any time. An update may require a newer version of iOS than the one you are running. We do not promise that any particular feature will keep working indefinitely, especially where it depends on a service run by someone else.

Support

Support is by email at [email protected], and the support page answers the common questions. We aim to reply, but we do not commit to a response time or to fixing any particular problem. Apple has no obligation to provide any maintenance or support for Atlas.

Services run by other people

Atlas relies on Apple for place names, map imagery and iCloud storage of your earned stamps, and it can hand a finished card to another app such as Instagram, TikTok or Messages when you choose to. Those services are governed by their own terms and privacy policies, and we are not responsible for them or for what happens to something after you send it to one of them.

No warranty

Atlas is provided as it is. To the fullest extent the law allows, we exclude all warranties, conditions and representations that are not expressly set out here, including any implied warranty of merchantability, fitness for a particular purpose, or accuracy. We do not warrant that the app will be uninterrupted or free of faults.

If you are a consumer in New Zealand, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Consumer law elsewhere may give you similar rights that cannot be excluded, and nothing here is intended to override those either.

Liability

To the extent the law allows, we are not liable for any indirect or consequential loss, or for lost data, lost profits, or travel decisions made on the strength of something Atlas showed you. Where liability cannot be excluded, it is limited to the amount you paid for the app, which is nothing.

If a claim relating to Atlas has to be handled, we handle it, not Apple. That includes any claim that the app fails to conform to a legal requirement, any product liability claim, and any claim that the app infringes someone else’s intellectual property.

Where you may use it

By using Atlas you confirm that you are not in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not on any United States government list of prohibited or restricted parties. This is a condition Apple requires of every app on the App Store.

Apple as a third party

Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and once you accept them Apple has the right to enforce them against you as a beneficiary.

Changes to these terms

If these terms change, the new version will be posted here with an updated date. Continuing to use Atlas after that means you accept the revised terms. If you do not, delete the app.

Law

These terms are governed by the law of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any dispute. If you are a consumer elsewhere, you may also have the right to bring a claim in your own country.
